1. Acceptance of Terms

By accessing, using, or participating in any activity, event, or program offered by OneTRIbe, you agree to be bound by these Terms and Conditions.

2. Membership Requirements

Membership is open to individuals who agree to abide by these Terms, OneTRIbe’s policies, and any and all applicable laws and regulations. By becoming a member, the individual certifies that they are in good health and physically fit. They will not enter or participate in any organizational event unless they are medically cleared to do so and have determined that they are adequately trained. Furthermore, they have not been advised against participation by a qualified medical professional. Members must complete any required registration process and maintain accurate and updated personal information.

3. Assumption of Risk

Participants acknowledge that involvement in physical activities and sports carries inherent risks, including but not limited to injuries, physical harm, or property damage. By participating, the participant voluntarily assumes all risks associated with these activities.

4. Waiver and Release of Liability

Members and participants agree to release, waive, discharge, and covenant not to sue OneTRIbe, its officers, agents, volunteers, and employees from any and all liabilities, claims, demands, or injuries, including death, that may be sustained while participating in group activities or events, or while on premises owned, leased, or used by OneTRIbe, including injuries sustained as a result of the negligence of OneTRIbe or its representatives.

5. Code of Conduct

Members and participants must adhere to OneTRIbe’s code of conduct, which promotes respect, fairness, and courtesy towards all members, participants, staff, and volunteers. OneTRIbe reserves the right to suspend or terminate membership for any violation of the code of conduct.

Sexual Misconduct Policy

Any and all forms of sexual misconduct shall be met with a penalty of expulsion, with no reimbursement of all fees paid for membership or activities. Sexual misconduct is a broad term that encompasses a range of behaviors which are sexual in nature and deemed inappropriate, unwelcome, or coercive, which may include harassment, stalking, indecent exposure, and assault.

The views, comments, and opinions expressed on online platforms, including social media sites, forums, and other digital channels, by members, participants, or any individuals associated with OneTRIbe, do not necessarily reflect or represent the official stance, opinions, or beliefs of OneTRIbe or its members. The Group is not responsible for, and expressly disclaims all liability for, the content of comments and opinions posted by its members or participants on any external websites or social media platforms.

Indemnification

In addition, the individual agrees to indemnify, defend, and hold harmless OneTRIbe, its members, participants, staff, volunteers, and representatives from any and all damages, costs, and expenses of any kind, including, but not limited to, civil and criminal damages, as well as attorneys’ fees, that arise from or are directly or indirectly related to, in whole or in part, their personal actions, their participation in any organizational event, their travel to and from any organization event, and their actions or inactions that cause injury or damages to any other person.

6. Privacy Policy

OneTRIbe is committed to protecting the privacy of its members. Personal information collected is used only for the purpose of providing services, managing membership, and communicating about group events and news. The group will not share personal information without consent, except as required by law. In line with this, the individual authorizes OneTRIbe to share their personal contact information, including but not limited to, their name, email address, phone number, address, and emergency contact information with organization representatives and others as necessary to facilitate organization events, contact them regarding membership or training program information, conduct organization business, or for emergency purposes.

Use of Likeness

Unless otherwise specified, the individual grants permission to OneTRIbe to use their name, photographs, motion pictures/videos featuring them or in which they appear, recordings of them, or any other record of their participation in events for any legitimate organizational purposes. These purposes include, but are not limited to, organizational newsletters, social media sites, promotional materials, and OneTRIbe’s website.

7. Fees

Membership dues, training program fees, and fees for organization events are non-refundable and non-transferable. An individual must maintain their status as a member in good standing throughout the duration of any training program. Credits or refunds may be issued on an exceptional basis at the discretion of OneTRIbe’s Board of Directors. Credits will not be provided retroactively for missed organization events, missed trainings, late arrivals, failure to provide necessary equipment or documentation, or lack of interest in any organization event.

8. Modification of Terms

OneTRIbe reserves the right to modify these terms at any time. Continued use of OneTRIbe’s services or participation in events following such changes will constitute acceptance of the new terms.

9. Governing Law

These terms shall be governed and construed in accordance with the laws of the jurisdiction in which OneTRIbe operates (the State of California), without regard to its conflict of law provisions.

10. Dispute Resolution

Any disputes arising out of or related to these terms or OneTRIbe’s services shall be resolved through mediation. If mediation is unsuccessful, disputes shall be resolved through binding arbitration.

Confirmation of Agreement

I confirm that I am eighteen (18) years of age or older, with full legal and juridical capacity to enter into binding contracts. I have reviewed these terms and conditions in full, and understand and agree to its contents without reservations.
